The guardianship and guardianship authorities have long been the subject of phobias for many parents. There has been an increase in the number of alarming messages that the guardianship makes checks, and sometimes takes the child from a completely prosperous family. If there is a threat to life

The reason why the guardianship authorities may come with an inspection, and in some situations, and take the child without a court decision, is a threat to the life and health of the child - on the basis of Article 77 of the Family Code of the Russian Federation.

And what is meant by a threat to life and health? This can be expressed in physical and psychological impact, neglect of the vital needs of the child, when the following happens in the family:

  • parents put pressure on the child's psyche, threaten and intimidate, humiliate;
  • beatings, especially under the influence of alcohol and drugs;
  • one or both parents are sexually harassing;
  • leaving the child unattended, clothing, food, proper hygiene;
  • unsuitable living conditions for children;
  • lack of medical supervision and assistance in case of a child's illness, lack of vaccination;
  • non-participation in the upbringing of the child.

The guardianship authorities do not conduct raids on apartments, therefore the reason for the visit may be a signal to which the guardianship is obliged to respond within three days from the moment the information is received.

Reporting a fact threatening a child can be oral or written, and can also be anonymous. The signal can come from citizens, workers of preschool and school institutions, medical workers from clinics and hospitals. Also, medical organizations are obliged to transfer information to the bodies of the Ministry of Internal Affairs of Russia on certain types of injuries. The procedure for examining the living conditions of a minor is regulated by order of the Ministry of Education No. 334 of 14.09.05.

Alarm points

During control and audit, attention is paid to the following facts:

  • The general condition of the housing where the child lives. If you do not go into details, then the room should be clean.
  • Housing and living conditions, access to dangerous household items, electrical appliances, gas, medicines.
  • The presence of a bed for a child, the maintenance of the bed.
  • Is there a place to practice and play.
  • The state of health of the child, the presence or absence of signs of physical or mental abuse.
  • Availability of food in sufficient quantity and age appropriate.
  • If there are animals in the house, then a very important point is their number and the condition of the animals themselves, the cleanliness of the cages, toilets.

The report records the conclusions during the check on the presence or absence of a threat to the life and health of the child.

Guardianship authorities may not be limited to home visits. Conversations with a child, parents, other family members are permissible. Interviewing neighbors, teachers, and other persons who can tell about the relationship between parents and children, observe them in everyday life.

They study documents in educational and medical organizations. Psychologists study the creative work of a child.

When custody can take children away

At the moment, there are many different "life stories" on this topic. Anxiety arises: what if something does not suit the guardianship during the check and the child will be taken away ?! There are many such misconceptions, sometimes parents bring the situation to the point of absurdity. The child has a high fever, vomiting (suspected poisoning). Indeed, physicians with such an appeal are obliged to transmit information about the call. And instead of immediately calling an ambulance, the intimidated mother does not do so, fearing a visit from the care staff. "The apartment is not cleaned, the refrigerator is empty …"

A native child can be taken away only when there is an immediate threat to life and (or) health, that is, lack of fruit and dirty floors are not a reason, the main thing is a complete lack of care and education.

If there is no immediate threat, then the guardianship authorities can conduct a conversation. Only if regular meetings do not lead to positive changes, they go to court, where the issue of restricting parental rights is considered.

How to reduce the likelihood of visiting care

Law-abiding parents should know simple rules:

  • Do not leave the hospital without discharge and a certificate of the birth of the child.
  • After the birth of a child, within a month, you must obtain a birth certificate and in the future draw up all the necessary documents.
  • If you plan to conduct medical supervision of the child in a private clinic, then notify the local doctor. You should also transfer information about the implementation of preventive vaccinations. If you are against the vaccination of your child, you should write a refusal to vaccinate at the local polyclinic.
  • Carry out adequate daily childcare. Clothing should be clean and appropriate for the child's weather and gender. The child must be clean (body, hair, nails).
  • If a child is engaged in sports sections, where he can get bruises, then it is worth warning the teachers.
  • If the child is absent from preschool or school, warn the teachers explaining the reason for the absence. If a child misses kindergarten not due to illness, then it is worth writing a statement indicating the period of the child's absence.
  • Do not leave your child unattended. By law, childcare can only be carried out by persons who have reached the age of majority.
  • Do not leave the child in conditions in which he cannot independently take care of preserving his life due to age or circumstances (in a closed car).
  • Do not abuse alcohol, do not use drugs.

It is impossible to completely exclude the visit of the guardianship and guardianship authorities, even observing all the "safety rules". As the guardianship authorities themselves admit, a complaint can be filed against the background of personal hostility by any person.

If the inspection authorities are still interested in your family, do not panic! Family education remains a priority. And even if the family is in a difficult situation, one can count on the support of the state and social assistance centers
